Article 1 – Identity of the entrepreneur

Article 2 – Definitions
Consumer: the natural person who does not act in the exercise of a profession or business.
Business customer: the natural person or legal entity acting in the exercise of a profession or business.
Entrepreneur: Sjaal met Verhaal BV.

Article 3 – Applicability
These terms of service apply to every offer made by Sjaal met Verhaal BV and to every agreement concluded via the webshop.

Depending on the status of the customer, additional provisions apply for consumers or business customers, as described below.

Article 4 – The offer
The offer contains a clear description of the products. Obvious mistakes or errors do not bind Sjaal met Verhaal BV.

Images are for illustrative purposes and aim to provide the most accurate possible representation.

Article 5 – Formation of the agreement
The agreement is concluded at the moment the customer completes the order and receives a confirmation by email.

Sjaal met Verhaal BV reserves the right to refuse orders or to impose additional conditions.

Article 6 – Prices
All prices are stated in euros.
For consumers, prices include VAT.
For business customers, prices may be shown excluding VAT.

Any shipping costs are clearly stated in advance.

Article 7 – Payment
Consumers pay immediately upon placing the order using the available payment methods.

Business customers pay using the agreed payment method and payment term, as stated on the invoice or agreed in the customer account.

Article 8 – Delivery
Orders are delivered to the address provided.

The risk of loss or damage remains with Sjaal met Verhaal BV until delivery to the customer.

Article 9 – Right of withdrawal (consumers only)
The consumer has the right to cancel the agreement within 14 days of receipt without giving any reason.

The withdrawal period starts on the day after receipt of the product.

Article 10 – Exercising the right of withdrawal (consumers only)
Withdrawal must be notified by email within the withdrawal period.

The product must be returned within 14 days after notification.

The costs of return shipment are borne by the consumer, unless stated otherwise.

Article 11 – Exclusion of the right of withdrawal
The right of withdrawal is excluded for consumers for products that:

– are made according to the customer’s specifications
– are personalised
– cannot be returned for hygiene reasons after the seal has been broken

Business customers do not have a right of withdrawal.

Article 12 – Warranty and conformity
For consumers, statutory conformity as laid down in the Dutch Civil Code applies.

For business customers, products must conform to the agreement, whereby deviations resulting from manual work or natural materials are acceptable within reasonable margins.

Article 13 – Complaints
Complaints can be submitted by email. We aim to respond to complaints within 14 days.

Article 14 – Disputes
These terms of service are governed exclusively by Dutch law.

Consumers may also submit disputes via the European Online Dispute Resolution platform:

Article 15 – Amendments
Sjaal met Verhaal BV reserves the right to amend these terms of service. The most current version will be published on the website.
